03 BMW x5 having Trans Failsafe Prog

Hi, I'm having this problem on my 03 BMW X5 3.0L that is making me scratch my head. The car worked well for years and now I'm getting this Trans Failsafe Prog everytime I first drive the car in the morning. It's giving me an Error 35 which is "Gear Monitoring 3". When this thing happens, I just turn it OFF, take the keys out, put it back, turn the car ON then drives fine! I was reading the forum about these problems and did some suggestions. For starters, I did replace the Transmission Fluid and Filter. It did not fix it so I had my battery checked. It was already failing so I thought that was it. I had it replaced last week. But then again, this problem still persist. Now I'm kind'a lost. The thing that bothers me is, IT ONLY HAPPENS ON MY FIRST START AND DRIVE THE CAR! I felt that is took a little bit longer to shift to 3rd gear. When I turn it OFF, pull the key out, put it back IN, then turn it ON again it drives fine! This could not be a Transmission problem isn't it? Any suggestion is very welcome. Thanks.

If you getting the message, you need to get the EGS module read to find out why you have the message. Throwing parts at it may or may not resolve the issue.

If I had to guess one of the speed sensor in the trans may be failing or one of the solenoid is failing. Car is getting old and things starts to fall apart.

Thanks for the quick response! So, I need to go to a BMW transmission specialist and have the TCM and all trans components checked? Hopefully it's just a minor repair...

mostly harmless is on a distinguished road
have this problem for some time on my 2001 4.4.
It seems to be a contact problem with the shifter in the park position.
starting in neutral takes care of the problem.
If I remember correctly there was a recall action in the US with the ID 4954 or something like that.
The tittle was something like "Replacement of the transmission gear position indicator switch"

Did your transmission problem shifted late on 3rd gear as well? That's when mine throws the code.

Still no luck on my Trans Failsafe message. I was checking on the voltage regulator and seems to be fine. So now I'm really out of option but to send it to a reputable transmission garage and diagnose it for me..... Will just wait and see...
