These trans are eminently repairable... jsut not by BMW mechanics. You need an AT repair shop with experience in this brand AT

Update: Went to a transmission shop on Friday and they told me this was not a transmission issue, but more of a throttle/air sensor mixture problem that is really affected by amplitude. He pulled out a SIB for it from 12/15 that I have updated back in June but didn't fix the problem. So, the guy suggested I start gunning parts out of the equation but have no idea where to start. Just noticed the car hesitates on switching gears when warming up, but once it's up to operating temp is a champ. Any ideas?

Why not give this another try?

"SIB ..I had updated..."??? (You dont update SIBs- sibs are documents..they may contain instructions, and those instructions might involve SW updates.)
"gunning parts"?

Ard, my bad...let's try again.

I meant ambient temperature - the car performs worse(and the issue comes up faster) on warmer temperatures rather than colder days when it may not even show the surging. I noticed that the car is in limbo trying to decide which gear it should be on whe slowing down at a stop, during the stop and is jerking from 2nd gear to 1st when I release the brake pedal to take off.

Not SIB but TSB is also what I meant - the service buletin was calling for a software update SI B12 32 15 and the one I had done was SI B12 36 15 which is the the newest update.
Gunning parts is what the dealer wanted to do to try eliminating the issue replacing part after part until they get it (hopefully)right.
