update:
still no parts for the recall, they say they are not allowed to give me the car back until they perform it! and yes you were right, they have been lying since the start! anyone have a similar experience? do I have any rights on this? they just keep pushing the expected parts date..

Send a note to BMWNA, certified, and tell them "pursuant to state law, I will proceed with a lemon law return at xx days. The car has been our of service for yy days, and is currently at your dealer with no estimated completion date."
They'll have the parts in 2 days. |
