My x5 broke down again!! do i have lemon?

I have 2006 x5 4.4. The first break down was on freeway, I lost power with entire dashboard lighting up, every single warning lights come on. I was on the first lane of interstate15, it was very close call. Riverside BMW changed main CPU, and they told me there was moisture built up there. What I don't understand is we get like 5-10 rainy days per year in southern california. What if I was somewhere in washington?? My X would have broke down every other month. That was about 4 months ago.
Last night I was out for my wife's birthday party. I was on carpool lane with heavy traffic. This time engine stalled and shut itself down this time. When I tried to restart, it wouldn't start again. I was stuck there for about an hour until towing truck came by.
I figure with all different safety features, x5 would be safe enough car for my family. However, what's use of all safety measures if car fails on the freeway. I think I had enough with BMW, it's the worst of the worst. My wife is so traumatized, she doesn't even want to see x5 again. Of course they will repair the car, and will offer a civic from enterprise rental car. But what about time lost & traumatizing experience??
I know we all love our x5, however, x5 fails 10 times more likely from my experience. So on special days don't take x5 out. Take something dependable one!

Doesn't qualify as a lemon, yet. Sounds like you need a new dealer for starters, a Civic as your driver while the car is in the shop? That is non-sense.

Moisture on the ECU sound shaky at best. Moisture could condense on a ECU simply because it is getting too hot, not necessarily a leak from rain.

If your family doesn't feel safe in it, then you need to get rid of it. This is not a common problem with the X5 and I seriously doubt it is a lemon since it is already 2 years old and was the last model of the E53 style.

Did you but this new or pre-owned?

If pre-owned, you should ask the dealer to run the service history for you.

I hope it works out for you.
